Welcome to Aarize, a web service dedicated to the discovery and presentation of artistic content, and the operation of contests where influencers curate and choose the art which will be awarded recognition and prizes. Aarize's site (aarize.com) is operated and provided by PhotoCulture, Inc. ("We," "Us," or "Aarize"). Our goals are to help people receive meaningful recognition and rewards, reach a wide, influential global audience, and inspire everyone who views the work on display.

By accessing and using the Aarize website and services (the “Service”), you accept and agree to be bound by the Terms herein. Please read the following Terms of Use carefully.

We may update these Terms of Use from time to time to reflect changes in our practices or legal requirements. Any changes will be effective immediately upon posting on the website. Your continued use of the Service after any changes indicates your acceptance of the new Terms of Use.

You must be at least 18 years old to participate in our competitions and submit your images for contests on Aarize.com.

You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

By posting Content, you warrant and represent that you are the author and own all right, title and interest to that Content and any likenesses contained in that Content. You agree to not post anything to which you do not have the ownership rights.

You are solely responsible for any data, text, software, music sound, images, photographs, graphics, video, messages, files or other materials ("Content") which is transmitted, posted, or distributed by you through Aarize.

Aarize does not claim and will not claim any ownership of the Content you submit or make available for inclusion on the Service.

By submitting Content to Aarize, you grant Aarize a limited, non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, display, reproduce, and distribute the Content on and through the Service.

You represent and warrant that you have all rights, power, and authority necessary to grant these rights to the Content you submit.

Aarize does not own or control the Content posted by Users via the Service, and does not guarantee the accuracy, integrity or quality of such Content. You may be exposed to Content posted by other Users that you might find offensive or objectionable. Under no circumstances will Aarize be liable in any way for any Content posted by any User or third party, including, but not limited to, liability for any errors or omissions in any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, e-mailed or otherwise transmitted via the Service.

Aarize and its designees have the right at their sole discretion to refuse or remove any Content, in whole or part, that in Aarize’s judgment does not comply with these Terms and Conditions or is otherwise undesirable, inappropriate or inaccurate. Aarize is not responsible for any failure, non-failure or delay in removing such Content. You will remain responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of such submitted material, including any Content or part thereof, or other communication to Aarize. You agree to immediately notify Aarize of any unauthorized use of the Service or any other breach of security that you know or suspect.

You agree to provide true, accurate, current and complete information about yourself as prompted by the contest submission form. If any information provided by you is untrue, inaccurate, not current or incomplete, Aarize reserves the right to reject any of your Content and to terminate your right to use the Site and refuse any and all current or future use of the Service.

You agree not to use the Service to:

• Post or transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity, including, but not limited to, an Aarize official, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Engage in any activity that interferes with or disrupts the Service.

Aarize operates contests where social media influencers curate and choose the art which will be awarded recognition and prizes.

The rules, eligibility, and prizes for each contest will be specified on the Aarize website.

Aarize reserves the right to disqualify any entry that does not comply with the contest rules.

A valid credit card is required for paying for your contest entry submissions. This is not required for any free contests.

There will be no refunds or credits after the Entry Deadline for any contests.

If your entry charge is denied, we will attempt to re-charge your PayPal account or Credit Card at least two times before suspending your account.

All fees are exclusive of all taxes or duties imposed by governing authorities. You alone are responsible for payment of all such taxes or duties.

Aarize reserves the right to terminate or suspend your account and access to the Service at any time, without notice, for conduct that Aarize believes violates these Terms of Use or is harmful to other users of the Service, or to Aarize's business interests. Further, Aarize reserves the right to terminate your right to use the Site and refuse any and all current or future use of the Services for any reason whatsoever.

The Service is provided "as is" and "as available" without any warranties of any kind. Aarize disclaims all warranties, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Aarize or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party; or (v) any errors or omissions in any Content or for any loss or damage of any kind incurred as a result of your use of any Content posted, emailed, transmitted, or otherwise made available via the Service, whether based on warranty, contract, tort, or any other legal theory, whether or not Aarize has been advised of the possibility of such damages.

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
